Astrel Instruments S.r.l. Online Sales Terms and Conditions

These Terms and Conditions page defines the rules on sales made through Astrel Instruments web site. The customer is requested to accept these Terms and Conditions by clicking on the “I accept” button on the order form. These Terms and Conditions can be modified by Astrel Instruments at any time by posting amended terms and conditions on Astrel Instruments website with a revised effective date.

 

Prices



Prices on the product pages and the order form are for immediate ordering only and are subject to change. Prices do not include shipping, which will be charged separately. Prices do not include VAT. We will charge Italian VAT (22%) for any orders shipped to Italy and to any private purchaser in EU. Orders of EU purchasers with a valid VAT number will not be charged Italian VAT. Extra EU purchasers' orders will not be charged Italian VAT. Shipping costs include VAT.

Availability



After web order or at any customer request will communicate  the lead time between the payment and the shipment. For orders that include parts with different lead time the customer can choose between a single shipment when the item with the longest lead time is available or separated shipment of each part as soon as it is available (writing his preferences on the "Note" field of the order form). In absence of any indication from the customer we will decide autonomously.

Payment Options



We accept Bank Transfer as preferable payment method. We accept Paypal payment as well (the Paypal fee will be in charge of customer).

Shipping, Title, Risk of Loss and Insurance

Once Astrel Instruments delivers the purchased parts to the selected shipping company, the purchaser become responsible for any risk of loss or damage. If the order is lost or damaged in shipment, the purchaser will have to make the claim against the shipping company. The purchaser can request purchase insurance from the shipping company on the "Note" field of the order form.

Warranty



Astrel Instruments provides two years warranty for all its own products. This period starts from the date of shipping. 

For parts (like filters) that are not Astrel Instruments' own products the terms of warranty are defined by the producers.

Once the defective product is back to its offices, Astrel Instruments will check the declared defect and, if any, will repair or replace the defective product at no charge to the purchase.

The warranty period for the repaired or replaced product will not exceed the original warranty period.

If during the checks it is clear that the defect has been originated by accident, abuse, or negligence, or by damage by water, heat, dust or other environmental cause, or by unauthorized repair or modification, Astrel Instruments will not consider the reparations or replacements under warranty and will communicate to the customer the cost of any action useful to remove the defect.

Before sending us any defective product the customer has to contact us to obtain a return material authorization (“RMA”) number and always refer to it in any communication that refers to this defective part.

Products must be sent in appropriate packaging and at customer's expense, together with proof of purchase and a letter that include the return address and a clear description of the fault.

In the warranty period repaired parts will be returned to the indicated address at no charge to the customer.

Outside the warranty period, all shipping costs are in charge to the customer.



THE FOREGOING WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, EITHER EXPRESS, IMPLIED, OR STATUTORY, REGARDING THE PRODUCTS, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS.

 

IN NO EVENT WILL WE BE RESPONSIBLE OR LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOST PROFITS, OR INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL OR CONTINGENT DAMAGES ARISING FROM OR RELATING TO THIS CONTRACT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY IN CONNECTION WITH THIS SALE, INCLUDING FOR ANY LIABILITY ON ACCOUNT OF A CLAIMED DEFECT IN ANY PRODUCT, WHETHER IN CONTRACT OR TORT OR OTHERWISE, SHALL IN NO EVENT EXCEED THE PURCHASE PRICE OF THE PRODUCT. ALL SALES ARE FINAL, NO RETURNS WILL BE ACCEPTED OTHER THAN AS PROVIDED IN THESE WARRANTY PROVISIONS.

 

Returns



Astrel Instruments' products can be returned during the first 7 days after receipt by the customer. All returns must be received at Astrel Instruments' offices in "Like New" condition. "Like New" means that the products are undamaged and have no defects, operate to original specifications, and have no surface marks or scratches. Products that arrive at Astrel Instruments not to be in "Like New" condition are subject to a restocking fee of up to 25% to restore the camera to original condition.

For all returns, please contact Astrel Instruments customer service using our contact form before returning your camera. All returns require an RMA number. Customers will be refunded via Bank Transfer.





Software License



The Astrel Instruments developed software tools and libraries are distributed under the GPL license, which is available here:

For other software tools and libraries which are part of the distribution preinstalled on the Astrel Instruments cameras, please refer to the specific licenses.

 

Jurisdiction

 

The court of Rome (Italy) shall have exclusive jurisdiction over any disputes relating to the terms and conditions mentioned above.
